Evangelicals and the other branches of extreme Christianity need to be reminded that America is NOT a country of one race or one religion. Their vehement pursuit of a white power, Christian-controlled country will be in vain. There will be threats and some victories in these fanatical attempts to end woman’s reproductive rights, however America’s diverse electorate will ultimately see to it that women, minorities, and immigrants have their constitutional rights upheld.
The Texas law is unconstitutional because in 1973, Roe v Wade became the law of the land, protecting a women’s right to obtain an abortion. Although the Supreme Court’s 5-4 ruling does not to block the Texas law from going into effect today, the court did not rule on the constitutionality of the new law. It is well known that the conservative judges on the court are pro-life, however they dodged ruling on the legality of the law. A summary of the ruling in the New York Times explained;
“Abortion providers who had challenged the law in an emergency application to the court had not made their case in the face of “complex and novel” procedural questions. The majority stressed that it was not ruling on the constitutionality of the Texas law and did not mean to limit “procedurally proper challenges” to it.”
The media has been commenting on this story with hysteria making predictions of the end of Roe v Wade and women’s reproduction rights. What the ruling actually did was temporarily take the right to abortion away from women in Texas. Abortion is now illegal in Texas after a pregnancy reaches 6 weeks. There are no exceptions in the law for rape and incest. The cruelty, religious fanaticism, and misogyny inherent in the law reveals the moral depravity of Governor Gregg Abbott and the Republican Texas state legislator.
Justice Sonia Sotomayor’s dissent strongly rebuked the ruling saying, “Presented with an application to enjoin a flagrantly unconstitutional law engineered to prohibit women from exercising their constitutional rights and evade judicial scrutiny, a majority of Justices have opted to bury their heads in the sand.” Sotomayor rejected the Texas Republicans frighteningly clever tactic which permitted the conservative Court to allow the law to go into effect. The Justice further explained, ” it cannot be the case that a State can evade federal judicial scrutiny by outsourcing the enforcement of unconstitutional laws to its citizenry.”
Legal opposition to the law is inevitable as the reproductive rights of women in Texas are now being violated. The Justices who voted to allow Texas women to be subjected to the cruel aspects of this law hid behind the malicious technicality that protects the state of Texas from being held accountable for violating the federal law by deputizing citizens to police the ontaining of abortions. Women in Texas are now going to suffer medical, emotional, and financial hardship because of this law which panders to the religious beliefs of a minority of Americans who deny science and live lives contrary to the values of their beloved Christianity.
American democracy and morality are under attack by religious hypocrites, misogynists, and autocratic, conservative power mongers. Republicans fight dirty and criminally in their pursuit of power, therefore Democrats must make the most of the power they slimly hold in our government, or democracy will be gone. Senator Joe Manchin is an obstacle to stopping the threat to democracy. He has to go!
